Klausner Lumber 1 & 2
Represented Seller in Two Ch. 11 363 Sales
SITUATION:
Two Austrian-owned sawmills in FL (KL1) and NC (KL2), abandoned at the start of the COVID pandemic with no management, no employees, no cash, and no accurate financial records. Both faced angry constituents (including Chinese EB-5 investors), lawsuits, defaults, and mounting judgments. Title to the NC property had reverted to the county and professionals were hired largely on a contingency basis.
NOTABLE ACCOMPLISHMENTS:
Asgaard and counsel defeated efforts to liquidate the facilities and equipment by EB-5 lenders at both mills, helped KL2 regain title to the NC property, and sold the mills in separate competitive auctions for $63 million (KL1) and $87 million (KL2); $150 million aggregate value versus an estimated forced liquidation value of less than $15 million. In addition, professionals won or successfully settled all contested motions in both cases, resolved all litigation with WARN Act claimants, and preserved the ability of EB-5 investors to obtain green cards. Sold for more than 10 times expected aggregate value.
